AN ORDIN= ANCE AMENDING CHAPTER 50 OF THE CODE OF THE BOROUGH OF NORWOOD REGARDING THE

ORGAN= IZATION OF THE POLICE DEPARTMENT

 

 

WHEREAS, the purpose of this ordinance is to amend Chapter 50 of the Code of the Bor= ough of Norwood to set forth with specificity the organization of and line of authority in the Norwood police department pursuant to N.J.S.A. 40A:14-118,= as applied in the case of Reuter v. Borough Cncl. of Fort Lee, 328 N.J. Super. 574 (App. Div. 2000),  = aff’d in part rev’d in part, 167 N.J. 38 (2001), and to make other revisions necessary to comply with current statutes.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Norwood as follows:

Section 1:  Chapter 50 of the Code= of the Borough of Norwood (“Code”) shall be amended so that the subsections 50-1 and -2 shall state the following:

§50-1. Police Department, Members, Line of Authority.

= A.&n= bsp;            = ;    The police department of the Borough of Norwood is =

hereby reestablished, ratified, and confirmed.&nb= sp; The department shall consist of the following members: one (1) chief= of police, one (1) lieutenant, two (2) sergeants, and ten (10) patrol officers.  Three (3) of the above-referenced officers may be members of the detective bureau.

 

         = The line of authority and relative rank of the police department shall be in the following order, beginning with the highest rank: chief, lieutenant, sergea= nt, and patrol officer.

 

 


 

Section 2:  Subsection 50-8 of the= Code establishing the position of Acting/Interim Chief is deleted and the positi= on of Acting/Interim Chief is hereby abolished in the Borough’s police department.

Section 3:  All ordinances or part= s of ordinances that are inconsistent with the provisions of this ordinance are hereby repealed, but only to the extent of such inconsistencies.

Section 4:  The provisions of this ordinance are severable.  If a= ny part of this ordinance is declared to be unconstitutional or invalid by any court, the remaining parts of this ordinance will remain in full force and = effect.

Section 5:  This ordinance shall t= ake effect upon final approval and publication, according to law.
