AN ORDINANCE AMENDING CHAPTER 233 THE CODE OF = THE

BOROUGH OF NORWOOD REGULATING ACCESSORY BUILDINGS

AND USES PERMITTED IN THE BUSINESS ZONE

 

 

WHEREAS<= /span>, the Mayor and Council of the Borough of Norw= ood is authorized to create and from time to time modify land use regulations consistent with N.J.S.A. 40:55D-1 et seq., the Municipal Land= Use Law, and the purpose of this ordinance is to better define the regulations = that apply to accessory structures and to permitted uses in the business zoning district.

NOW, THEREFORE, BE IT ORDAINED by = the Mayor and Council of the Borough of Norwood, Cou= nty of Bergen, State of New Jersey, as follows:

Section = 1:  Section 233-3(B) of Chapter 223 of the Code of

the Borough shall be amend= ed to include the following definition:

Required ya= rd – Any front, rear, or side yard that is required by the provisions of this Chapter to be maintained on lots located in any zoning district.

Section 2:       Secti= on 233-26 of Chapter 223 of the Code of

the Borough regulating acc= essory uses shall be amended to add the following sub-sections:<= /p>

D.  =       Accessory buildings shall not be located in any

required yard, and shall b= e set back at least ten (10) feet from the principal building.

E.  =       No accessory building shall exceed the height of

twenty-five (25) feet or t= he highest point of the principal structure on the lot, whichever is lower.

F.  =        No accessory building may be used for human

habitation and no accessory building in any residential zoning district may be used for business or commercial purposes.

Section 3:       Secti= on 233-30 of Chapter 223 of the Code of

the Borough regulating the= uses permitted in the business zoning district shall be amended to add the follo= wing sub-section:

G.  =       Notwithstanding the above, the following uses are

not permitted in the busin= ess zoning district:

1.  =        Massage parlors or establishments.

2.  =        Tattoo parlors or establishments.

3.  =        Automobile junk yards, automobile, bus, truck, and other motor vehicle storage yards.<= o:p>

4.  =        Building material storage yards.

5.  =        Carting, express, hauling, or storage yards for solid waste and/or recycling collect= ion and disposal.


6.  =        Livery or boarding stables for animals, but veterinary hospitals providing short-t= erm stays for animals receiving medical treatment in a stand alone building are permitted.

7.  =        Metal or woodworking shops.

Section = 4:  &= nbsp;    All ordinances or parts of ordinances that

are inconsistent with the provisions of this ordinance are hereby repealed, but only to the extent of= any inconsistencies.

Section 5:       The provisions of this ordinance are

severable.  If any part of this ordinance is declared to be unconstitutional or invalid by any court, the remaining part= s of this ordinance will remain in full force and effect.

Section 6:       This ordinance shall take effect upon

passage and publication in accordance with N.J.S.A. 40:49-2(d) and copies shall be served on the County Planning Board and the Borough’s tax assessor within thirty (30) days= of adoption.  <= /p>
