An Ordinance Amending Chapter 233 of th= e Code of

the Borough of Norwood to Increase the Maximum Fines and

Penalties that May Be Imposed for Viola= tions of Borough

Zoning and Land Use Ordinances

 

W= HEREAS, the purpose of this ordinance is to u= pdate the sections in the Code of the Borough of Norwood to increase the fines and penalties that may be imposed upon those who violate Borough ordinances, as authorized by N.J.S.A. 40:49-5.

N= OW, THEREFORE, BE IT ORDAINEDS= ection 1:    Chapter 233 of the Code of the Borough of Norw= ood is amended to add the following new section:

233-135A. Maximum Fines and Penaltie= s.       =

 

A.   Any person who is convicted f= or a violation of any provision of this Chapter of this Code or any other ordinance of the Borough relating to zoning, land use, or planning for which no penalty is specified shall be subject to one or more of the following: a fine of not m= ore than two thousand dollars ($2,000.00), imprisonment for any term not exceed= ing ninety (90) days, and/or a period of community service not exceeding ninety (90) days, unless a different penalty is stated in the Code chapter hereof = or the ordinance.

 

B.   Any person who is convicted f= or a violation of any housing or zoning provision of this Code who shall be the subject of a fine on an amount that is greater than $1,250 shall be afforded the opportunity to cure or abate the condition within 30 days and shall be afforded an opportunity for a hearing before the court for an independent determination concerning the violation.&nb= sp; After the 30-day period, the court may impose a fine greater than $1= ,250 if the court determines that the cure or abatement of the violation has not been substantially completed.

 

C.  A separate offense or violation sh= all be deemed to be committed on each day that a violation occurs or continues.

 

S= ection 2:    All ordinances or parts of ordinances that are inconsistent with the provisions of this ordinance are hereby repealed, but only to the extent of any inconsistencies.

S= ection 3:    The provisions of this ordinance are severable.  If any part of this ordinance is declared to be unconstitutional or invalid by any court, the r= emaining parts of this ordinance will remain in full force and effect.

S= ection 4:    This ordinance shall take effect upon final approval and publication, according to law.
