Amending the Code of the Borough of Norwood to Add a New

Chapter 106 Requiring Certificates = of Continued Occupancy

and to Repeal Chapter 143 Regarding Housing Standards<= o:p>

 

, the purpose of this ordinance is = to repeal Chapter 143 of the Code of the Borough of Norwood regarding housing standar= ds and to establish a new Chapter 106 in the Code to require certificates of conti= nued occupancy, to better protect the health, safety, and welfare of the residen= ts of the Borough.

by the Mayor and Council of the Borough of Norwood as follows:

:  The Code of the Borough of Norwood= is amended to add a new Chapter 106 to state:

§ 106-1. Certificate of Continued Occupancy Required.

 

A.    No person shall sell, r= ent, or lease any dwelling unit to any person intending to use the dwelling unit= for residential purposes, or allow any person to inhabit any one- and two-family dwelling unit, unless a certificate of continued occupancy has been obtained from the Construction Code Official.

 

B.    Standards for issuance.

 

(1)  If the Construction Code Official, after a general inspection of the visible p= arts of a structure, determines that a dwelling unit is fit for human habitation= and complies with the Borough’s property maintenance code and all other ordinances of the Borough pertaining to building, plumbing, electrical, hea= lth, safety, fire, and minimum building standards, and that no violations of sta= te law or of the State Uniform Construction Code exist, which would prevent the issuance of a certificate of continued occupancy pursuant to that code, or = the regulations pursuant to that code, he shall issue the certificate of contin= ued occupancy.

 

 

(2)  If the Construction Code Official, as a result of a general inspection of the visible parts of a structure, finds any violation as set forth in Subsectio= n A, he shall notify the owner of the violation and allow the owner 14 days to correct the violation by mailing a written notice by certified mail, return receipt and regular mail, or by delivering the notice to the owner or his agent. The notice shall identify the premises and specify the violations and any required remedial action. The notice shall state that the failure to correct the violations within the time specified shall constitute a violati= on of this chapter and may be punishable in accord with Chapter 174 of this Co= de.

 

(3)  Any violation of the ordinances, codes, and statutes referred to in Subsection = B(2) shall be grounds for the d= enial of a certificate of continued occupancy.

 

C.    Applications for certificate.

 

(1)  Any owner intending to sell, rent, or lease any dwelling unit, or intending to allow any person to inhabit a dwelling unit, shall apply to the Constructio= n Code Official or his agent for a certificate of continued occupancy. Within seven days of the receipt of the payment of the required fee and the completed ap= plication form, the owner shall afford the Construction Code Official the opportunity= to inspect the interior and exterior of the structure and shall consent to the inspection. Within 14 days of the inspection, the Construction Code Officia= l or his agent will issue a certificate of continued occupancy or deny the same, setting forth the reasons for any denial as set forth above. The fee for the initial inspection shall be $85. The fee for a second and any additional reinspections shall be $25 for each inspection.

 

(2)  All applications for certificates of continued occupancy shall be made in writi= ng and shall state the name and address of the owner of the structure; the name and address of the owner-occupant or tenant-occupant or any other occupant = of the structure; if a sale or transfer of title, the name and address of the seller, transferor, buyer, and the new proposed occupants; and the name and address of the renting agent. It shall also describe the premises to be occupied, including the street address, and a designation of the portion or portions of the premises or structures for which the application is being m= ade, and shall set forth the number of persons who shall occupy any and all port= ions of the premises.

 

(3)  All owners or rental agents of real estate or a person or persons applying for a certificate of continued occupancy shall advise the Construction Code Offic= ial or his agent of a reasonable time or times when the inspection may be made = and shall have someone present to assist and provide entry for the inspection purpose= s.

 

 

 

§ 106= -2. Enforcement and Penalties.         =           =             &nb= sp;            =             &nb= sp;            =             &nb= sp;         

      This ordinance shall be enforced b= y the Borough’s Construction Code Official.  A= ny person convicted on a charge of violating the provisions of this ordinance shall be subject to the penalties set forth in Chapter 174.

 

:  Chapter 143 of the Code, titled “Housing Standards,” is hereby repealed. 

:  All ordinances or parts of ordinan= ces that are inconsistent with the provisions of this ordinance are hereby repe= aled, but only to the extent of any inconsistencies.

:  The provisions of this ordinance a= re severable.  If any part or par= ts of this ordinance is or are declared to be unconstitutional or invalid by any Court, the remaining parts of this ordinance will remain in full force and effect.

Section 5:  This ordinance shall take effect u= pon final approval and publication, according to law.
