AN ORDINANCE AMENDING CHAPTER 98 OF= THE CODE OF

THE BOROUGH OF NORWOOD REGARDING ES= CROW

FEES AND DEPOSITS FOR BUILDING CONSTRUCTION

 

, the purpose of this ordinance is = to amend the provision of the Code of the Borough that establishes the escrow deposit fee charged for site and grade plan review made by the Borough Engi= neer for permit reviews, to protect the health, safety, and welfare of the resid= ents in the Borough.

by the Mayor and Council of the Borough of Norwood, County of Bergen, State= of New Jersey:

: Section 98-3(B)= of Chapter 98 of the Code of the Borough, titled “Building Construction, Fees,” shall be amended to add a new sub-section 10 stating:

= (10)      For all construction modifying the footprint of any principal building or structure, each applicant will deposit a fee of $500 for one-family and two-family residential dwellings and $1,000 for all other uses, and thereafter maintai= n an escrow account of not less than the applicable amount set forth herein with= the Borough, to reimburse the Borough for the cost of site and grade plan revie= w to be made by the Borough Engineer for pre-construction and post-construction approvals.  The unused portion= , if any, of the escrow deposit shall be returned to the applicant upon completi= on and final approval of the improvements.&nb= sp; This fee shall be in addition to the permit fees that are otherwise required by the Building Department.        

:   All ordinances or parts of ordinances that are inconsistent with the provisions of this ordinance are hereby repealed, but only to the extent of any inconsistencies.<= /span>

:  The provisions of this ordinance a= re severable.  If any part of this ordinance is declared to be unconstitutional or invalid by any court, the remaining parts of this ordinance will remain in full force and effect.

:  This ordinance shall take effect u= pon passage and publication according to law.        =             &nb= sp;
