Ordinance No. 06:17

 

An Ordinance Amending Chapter 53 of the Code

of the Borough of Norwood<= /st1:place> Regarding Police Promotions

 

 

WHEREAS, = the purpose of this ordinance is to revise and update the criteria to be used in the consideration of persons for the promotion in the Borough’s police department.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Nor= wood as follows:

Section 1:  The Section 50-3 of the Code of the Borough of Norwood is amended to state:

§ 50-3.  Appointments and promotions general= ly.

A.

Members of the Police Department shall be appointed initially and promoted by the Mayor's nomination and appointment, with the advice a= nd consent of the Council, in accordance with N.J.S.A. 40A:60-1 et seq.   

 

B.

Promotions. 

(1)

Promotions. All promotions shall be made from within the membership of the Department as constituted at the time of such promoti= on.  All members of the Police Depa= rtment hired after January 1, 2005 in order to be promoted to Sergeant or above, must = have a Bachelors’ degree.

(2)

Eligibility. The promotion list shall expire two years aft= er the posting date of the final scores of the completed examination.

 

(a)

Sergeants.  Candidates must have completed three years in the rank of patrolman, in this Department, prior to date of written examination.  

 

(b)

Lieutenants.

Candidates must have completed one year in the rank of= Sergeant. = Time performing as Acting Sergeant is not to be counted.)

If all candidates for Lieutenant fail in the testing procedure, another complete examination is to be administered with = the requirements for eligibility to be as follows:

 

 

[a]

Candidate must be a full-time sworn officer of this Department.

[b]

Candidate must have completed at least seven years a= s police officer with at least three years as a member of this Department.=

 

 

(3)

Examinations.

(a)

As an aid in determining the qualifications of the membe= rs of the department, said members who meet the requirements and wish to= be candidates for the position of Sergeant or Lieutenant will be required to take written and oral examinations. They will also be required to appear before a Promotional Board in order to exhibit their knowledge of police work = and departmental duties, and finally, as set forth herein, candidates wil= l be required to pass psychological testing.

(b)

At least 60 days prior to the date a written examination= is scheduled, a notice shall be posted at the Police Department that will set forth the following:

The position available through promotion. <= /span>

The date the examination will be conducted.

[3]

The location of the examination.

[4]

The time the examination will begin.

[5]

A list of study materials.

(c)

The written examination shall be administered by a recognized agency selected by the Mayor, Council and the Police Chief= .

 

The oral exam will be conducted by the Police Chief, the Mayor and the Police Commissioner.

(d)

Ties. In the event of a tie in the final score of any tw= o or more candidates, preference shall be given to the candidate who is a resident of the municipality.

(e)

Sergeant. Candidates= shall be evaluated on the following four factors in the order shown: <= /o:p>

Written examination: 20 points.

[2]

Oral examination: 35 points.

[3]

Promotional rating: 40 points.

[4]

Seniority: 5 points.

(f)

Lieutenant. Candidates shall be evaluated on the followi= ng three factors in the order shown:

Written examination: 20 points.

[2]

Oral examination: 35 points.

[3]

Promotional rating: 45 points.

Sergeant's test proced= ure.

(a)

Each candidate shall be graded with the grade computed on the basis of 100 being a perfect score.

(b)

Each candidate may achieve a final point credit equal to= 20 points on the written portion and 35 points on the oral portion of the examination. This credit is achieved by multiplying the grade attaine= d by 35 or 20 and then dividing by 100.

 

Example: Grade 70 x 35 =3D 2,450 /100 =3D 24.5

 

Grade 70 x 20 =3D 1,400/100 =3D 14.0=

(c)

After the written portion of the examination, the seven candidates with the highest point totals will proceed on to the oral portion of the examination. All ties for seventh position will be eligible to continue.

(d)

After the oral testing portion, the points for the writt= en and oral portions for the examination will be added for each candidate and only the top five candidates will continue in the testing procedu= re.

(e)

Promotion rating (merit) shall be administered by the Ma= yor and Council and the Chief of Police who shall be referred to as the "Promotional Board." This Board will interview and grade ea= ch and every candidate. Factors to be considered by the Board in scoring= the candidate's ability shall be:

Performance and leadership skills. <= /p>

Educational background.

[3]

Training.

[4]

Supervisory experience.

[5]

Attitude:

[a]

Use of sick time.

[b]

Efforts in supporting the Department's goals and objectives.

[c]

Handling the Department's equipment.

[d]

Rapport with fellow employees and the public. <= /o:p>

Demeanor.

(f)

Each member of the Board shall grade all candidates on t= he basis of 100 being a perfect score. The scores of each Board member f= or a particular candidate shall be added together, the total then divided = by the number of members on the Board. This total shall be the candidate= 's grade.

(g)

Each candidate may achieve a final point credit equal to= 40 points. This credit is achieved by multiplying the grade attained by = 40, then dividing by 100.

 

Example: Grade 78 x 40 =3D 3,120/100 =3D 31.2

(h)

A maximum of five points may be attained for seniority. =

One-quarter point per anniversary year, or portion thereof, from date appointed as a probationary patrolman, computed = at the date of written examination. Maximum points attainable are five= .

Officers who leave the Department on a temporary basis= for United State= s military duty and immediately return upon completion of their tour = of duty are credited with that time the same as if they never left the Department.

Lieutenant's test procedure.

(a)

Each candidate shall be graded with the grade computed on the basis of 100 being a perfect score.

(b)

Each candidate may achieve a final point credit equal to= 20 points on the written portion and 35 points on the oral portion of the examination. This credit is achieved by multiplying the grade attaine= d by 35 or 20 and then dividing by 100.

 

Example: Grade 70 x 35 =3D 2,450/100 =3D 24.5

 

Grade 70 x 20 =3D 1,400/100 =3D 14.0=

(c)

After the written portion of the examination, the five candidates with the highest point totals will proceed on to the oral portion of the examination. All ties for the fifth position will be eligible to continue.

(d)

After the oral testing, the points for the written and o= ral portions for the examinations will be added for each candidate, and o= nly the top three candidates will continue in the testing procedure.

(e)

Promotional rating (merit) shall be administered by the Mayor and Council and the Chief of Police, who shall be referred to as the "Promotional Board." This Board will interview and grade each and every candidate. Factors to be considered by the Board in scoring the candidate's ability shall be:

Each candidate may achieve a final point credit equal to= 45 points. This credit is achieved by multiplying the grade attained by = 45 then dividing by 100.

 

Example: Grade 78 x 45 =3D 3,510/100 =3D 35.1

 

 

(6)

Required minimum total point score. Candidates for Sergeant or Li= eutenant must achieve a minimum total point score of 65 in order to be promoted = or placed on the eligibility list.

(7)

Letter of intent; requirements.

(a)

Each candidate for the position of Sergeant or Lieutenant is required= to write a letter of intent which will state his or her intention to take part in the examination procedure.

(b)

Members who do not meet the requirements to be eligible = for complete participation may, upon approval of the Chief of Police, take the written portion of the examination for exercise or practice only.= The cost, if any, for participating in the examination process shall be t= he candidate's responsibility. The results of such examination will have= no bearing on that examination or any future examination.

(8)

Removal from promotional list. The name of any eligible officer shall be removed from the eligible promotional list for any of = the following or other valid reasons:

(a)

Permanent appointment to the position for which the list= was promulgated.

(b)

Inability, unavailability or refusal to accept the appointment.

(9)

Notice of exam. Sixty days prior to the date for the examination for promotion, a notice will be posted on the bulletin boar= d in police headquarters informing the members of the Department that testing will be held. The notice shall give the date, time and location for the test and a list of study guides.

 

Section 2:  All ordinances or parts of ordinan= ces that are inconsistent with the provisions of this ordinance are hereby repealed, but only to the extent of any inconsistencies.<= /p>

Section 3:  The provisions of this ordinance a= re severable.  If any part or par= ts of this ordinance is or are declared to be unconstitutional or invalid by any Court, the remaining parts of this ordinance will remain in full force and effect.

Section 4:  This ordinance shall take effect u= pon final approval and publication, according to law.
