ORDINANCE NO. 06:19

AMENDING CHAPTER 177 OF THE CODE OF= THE BOROUGH OF NORWOOD= ENTITLED "PROPERTY MAINTENANCE"

the purpose of this ordinance is to adopt, pursuant to N.J.S.A. 40:49= -5.1, the 2006 version of the International Property Maintenance Code of the International Code Council (“ICC CodeR= 21;), a copy of the ICC Code is attached to this ordi= nance, and three copies of the ICC Code have been plac= ed on file in the Office of the Borough Clerk for use and examination by the publ= ic upon the introduction of this ordinance and will remain on file until final action is taken on the ordinance; and

the Mayor and Council finds that i= t is in the best interests of the Borough that the ICC Code be adopted and that the current Chapter 177 in the Code of the Borough= be repealed.

by the Mayor and Council of the Borough of Norwood that the Code of the Bor= ough of Norwood be amended as follows:

: Chapter 177 of = the Code of the Borough of Norwood shall be repealed and shall be replaced with= the following:

CHAPTER 177

PROPERTY MAINTENANCE

247-1 Adoption = of ICC Code with Amendments.

A certain document, three (3) copie= s of which are on file in the office of the Clerk of the Borough of Norwood, bei= ng marked and designated as the International Code Council’s Internation= al Property Maintenance Code, 2006 (“ICC Code”) as published by the International Code Council, is hereby adop= ted as the property maintenance code of the Borough of Norwood, in the State of= New Jersey; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and term= s of the ICC<= /span> Code are hereby referred to, adopted, and made a part hereof, as if fully s= et out in this ordinance, with the following addition, insertions, deletions a= nd changes:

A.   &nbs= p;    Section 101.1. Title is hereby supplemented by the addition of the words “Bor= ough of Norwood” as the name of the jurisdiction.

B.   &nbs= p;     Section 103.5. Fees is hereby supplemented by the addition of a minimum penalty of fifty ($50.00) dollars, a maximum penalty of five hundred ($500.00) dollars and/or imprisonment for a period not to exceed thirty (30) days for violati= ons of this section

C.   &nbs= p;    Section 302.4. All premises and exterior property shall be maintained free from wee= ds or plant growth in excess of ten (10”) inches.

D.   &nbs= p;    Section 304.14. Insect screens is hereby supplemented by the insertion of the dates April 1^st to October 1^st where applicable and in that order.

E.   &nbs= p;     Section 602.3. Heat Supply is hereby supplemented by the insertion of the dates Oct= ober 1^st to April 1^st where applicable and in that order.<= o:p>

F.   &nbs= p;     Section 602.4. Occupiable workspaces is hereby suppleme= nted by the insertion of the dates October 1^st to April 1^st where applicable and in that order.

G.   &nbs= p;    The first sentence of Section 106.4 is amended to state: “Any person who shall be convicted on a charge of violating the provisions of this code sha= ll be subject to the penalties set forth in Chapter 174 of the Code of the Bor= ough of Norwood.”

: All ordinances = or parts of ordinances that are inconsistent with the provisions of this ordin= ance are hereby repealed, but only to the extent of such inconsistencies.

: The provisions = of this ordinance are severable. If any part of this ordinance is declared to be unconstitutional or invalid by= any court, the remaining parts of this ordinance will remain in full force and = effect.

: Nothing in this ordinance or in the ICC Property Maintenance Co= de hereby adopted shall be construed to affect any suit or proceeding pending = in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed by this ordinance; nor shall any just or legal right or remedy of = any character be lost, impaired, or affected by this ordinance.

: Three copies of= the ICC Property Maintenance Code adopted by this ordinan= ce shall remain on file in the Borough’s Building Department offices, for the use and examination of the public, as long as this ordinance is in effe= ct, pursuant to N.J.S.A. 40:49-5.2

Section 6:&= nbsp; This ordinance shall take effect immediately upon final passage and publication as required by law.
