AN ORDINANCE AMENDING CHAPTER 233 T=
HE
CODE OF THE BOROUGH OF NORWOOD REGU=
LATING
ACCESSORY BUILDINGS AND USES PERMITTED IN THE BUSINESS ZONE
WHEREAS,
the Mayor and Council of the Borough of Norwood is authorized to create and
from time to time modify land use regulations consistent with N.J.S.A. 40:5=
5D-1
et seq., the Municipal Land Use Law, and the purpose of this
ordinance is to better define the regulations that apply to accessory
structures and to permitted uses in the business zoning district.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Bo=
rough
of Norwood, County of Bergen, State of New Jersey, as follows:
Section 1: Section 233-3(B) of Chapter 223 of=
the
Code of the Borough shall be amended to include the following definition:
=
Required
yard – Any front, rear, or side yard that is required by the provisio=
ns
of this Chapter to be maintained on lots located in any zoning district.

ection
2: &=
nbsp; Section
233-26 of Chapter 223 of the Code of the Borough regulating
accessory uses shall be amended to =
add
the following sub-sections:
D.&=
nbsp; Accessory
buildings shall not be located in any required yard, and shall be set back =
at
least ten (10) feet from the principal building.
E.&=
nbsp; No
accessory building shall exceed the height of seventeen (17) feet or one and
one-half (1-1/2) stories.
F.&=
nbsp; No
accessory building shall be used for human habitation.
G.=
No
accessory building that is located in a rear yard may occupy an area greater
than fifteen per cent (15%) of the total area of the rear yard.

Section
3: &=
nbsp; Section
233-30 of Chapter 223 of the Code of the Borough regulating the uses permit=
ted
in the business zoning district shall be amended to add the following
sub-section:
G.&=
nbsp; Notwithstanding
the above, the following uses are not permitted in the business zoning
district:
1.&=
nbsp; Massage
parlors or establishments.
2.&=
nbsp; Tattoo
parlors or establishments.
3.&=
nbsp; Automobile
junk yards.
4.&=
nbsp; Building
material storage yards.
5.&=
nbsp; Carting,
express, hauling, or storage yards for solid waste and/or recycling collect=
ion
and disposal.
6.&=
nbsp; Livery
or boarding stables.
7.&=
nbsp; Metal
or woodworking shops.
Section 4: =
All
ordinances or parts of ordinances that are inconsistent with the provisions=
of
this ordinance are hereby repealed, but only to the extent of any
inconsistencies.
Section 5:&n=
bsp; The
provisions of this ordinance are severable. If any part of this
ordinance is declared to be unconstitutional or invalid =
by
any court, the remaining parts of this ordinance will remain in full force =
and
effect.

Section
6: &=
nbsp; This
ordinance shall take effect upon passage and publication in accordance with
N.J.S.A. 40:49-2(d) and copies shall be served on the County Planning Board=
and
the Borough’s tax assessor within thirty (30) days of adoption.
