Amending Chapter 198 of the Code of=
the
Borough of Norwood to Regulate the Collection and Disposal of Solid Waste,
Bulky Waste, and Recyclables
, the Mayor and Council of the Boro=
ugh of
Norwood has the authority to enact ordinances regulating the collection and
disposal of solid waste, bulky waste, and designated recyclables, and finds
that the health, safety, and welfare of the residents of the Borough of Nor=
wood
will be advanced by this ordinance.
by the Mayor and Council of the Borough of Norwood, County of Bergen, State=
of
New Jersey, as follows:
Section 1:&n=
bsp; Chapter
198 of the Code of the Borough of =
span>Norwood
is amended at
Section 198-1 to add the following
definitions:
=
“Bulky
Waste” - Type 13 waste as defined by the current applicable New Jersey
statutes and/or regulations.
=
“Solid
Waste” - Solid waste types 10, 23, 25, and 27 as defined by the curre=
nt
applicable New Jersey statutes and/or regulations. Solid waste shall not consist of
recyclable materials, hazardous waste, or solid animal and vegetable wastes
collected by swine producers licensed by the State Department of Agricultur=
e to
collect, prepare and feed such waste to swine on their own farms.
=
“Recyclable
Material” - Magazines and newspapers, corrugated cardboard, glass,
ferrous scrap, mixed paper, and aluminum scrap.
Section 2:&n=
bsp; Chapter
198 of the Code of the Borough of
Norwood is amen=
ded to
replace the existing Sections 198-3 to 198-5 with the following:
§198-3. Municipal
Collection Procedures =
A.&=
nbsp; All
owners, operators, or occupants of all premises, except those exempted by
Section 198-4, shall place at the curb along public streets and roads all s=
olid
waste and recyclable material generated on the premises in suitable contain=
ers
that do not exceed fifty (50) pounds when full and all bulky waste on the d=
ays
designated for pick-up at or after the time designated by the Mayor and Cou=
ncil
in its rules and regulations that may be adopted from time to time by resol=
ution. All loose items are to be securely=
tied
in bundles not exceeding three feet in length nor sixty (60) pounds in weig=
ht,
which shall be place at the curb in accordance with this section.
B.&=
nbsp; The
Borough is not obligated to pick up solid waste, bulky waste, or recyclable
materials from any containers not placed at the curb along public streets or
roads, or from any dumpsters or similar large containers other than suitable
containers weighing less than 50 pounds each when full. It shall be the duty of all owners,
operators, and occupants of all premises to remove and dispose of, at their=
own
expense, all material deposited in dumpsters or other similar large contain=
ers
exceeding the weight limit set forth herein.
§198-4. Owners
and Occupants Required to Provide Private Removal and Disposal
A.&=
nbsp; It
shall be the duty of the owner, operator, or occupant of all business, industri=
al,
and commercial premises, and all residential uses as to which the owner does
not comply with Section 198-3, other than residential dwellings located on
Borough-owned property that is leased to non-profit corporations operating =
low
and moderate income or age restricted housing, to remove all solid waste, b=
ulky
waste, and recyclable material generated at the expense of the owners, oper=
ators,
or occupants of the premise.
B.&n=

;
Owners,
operators, or occupants of residential, business, industrial, or commercial
premises shall not deposit solid waste, bulky waste, or recyclable material
accumulated on or in the premises in Borough litter and/or Borough garbage
containers located anywhere in the Borough.
§198-5. Frequency
of Removal
=
All
owners, operators, or occupants required to remove or provide for the remov=
al
of garbage under Section 198-4 shall arrange for garbage and recycling pick=
-ups
of sufficient frequency to avoid the creation of any nuisance or unsafe
condition, provided that at least two garbage pick-ups per week shall be the
minimum frequency.

ons
A.&n=
bsp;
Any
person who violates any provision of Chapter 198 shall, upon a conviction, =
be liable
for a penalty as follows:
1. First offense - Written warning, p=
lus
court costs.
2. Second offense - Fine of not less =
than
$100 and not more than $1,000, plus
court costs.
3. Third and all subsequent offenses =
- Fine
of not less than $100 and not more than &nb=
sp; =
$2,00=
0,
plus court costs.
B.&n=
bsp;
Each
day that any violation exists or continues shall constitute a separate offe=
nse.
C.&n=
bsp;
In
addition to the penalties referred to in Sub-sections A and B, any person
convicted of violating the provisions of Chapter 198 on a third offense sha=
ll
be obligated to provide for the removal of the solid waste, bulky waste, and
recyclable material generated on the premises in accordance, and, if applic=
able,
shall forfeit the right to municipal collection and disposal.
: All ordinances or parts of ordinan=
ces
that are inconsistent with the provisions of this ordinance are hereby
repealed, but only to the extent of any inconsistencies.
: The provisions =
of
this ordinance are severable. If
any part of this ordinance is declared to be unconstitutional or invalid by=
any
Court, the remaining parts of this ordinance will remain in full force and =
effect.
: This ordinance shall take effect on
April 1, 2006, after approval and publication, according to law.
